Many of the 21% of rejected provisional ballots were valid under the rules in place before SoS Ken Blackwell changed them in 2004, which counted provisional ballots cast anywhere in the county. Blackwell's intent was to disenfranchise Democratic voters - an act of fraud comparable to Katherine Harris' fraudulent felon purge.
92,672 (or is it nearly 97,000?) "spoiled" ballots (undervotes and overvotes): As Florida 2000 proved, machine failures disproprortionately hurt Democrats. These votes must be counted.
How much unquantifiable fraud was committed? Lots, according to the Moss v. Bush lawsuit, Democrats on the House Judiciary Committee (also follow-up), Ray Beckerman, dKosopedia, FreePress.org, rincewind, and Greg Black. Here is a great map of Ohio problems. As in Ukraine, the U.S. Presidential election should be rescheduled because of widespread fraud.

12/28 Ken Blackwell refused to appear at a deposition on December 27 and sought a court order to avoid testifying.
12/28 Statewide recount added 734 votes for Kerry and 449 for Bush, reducing Bush's margin to 118,457.
12/25 Voters in the Mahoning Valley (including Youngstown) testified for 3 hours at a hearing about pre-punched ballots; touch-screen vote switching; more absentee votes than absentee voters; unfair provisional voter deletions; change of voting sites on Election Day. voter suppression; voter intimidation; double voting; malfunctioning machines; recalibrated machines; evidently rigged machines; and even 25 million negative votes registered in some races. One pattern that has been documented based on the experience of voters in Florida, New Mexico, Ohio, and elsewhere (especially in swing states) is the machines appear to have been set with a default to Bush.

12/24 Lucas County: Richard Hayes Phillips found a disturbing pattern: the 14 wards with the highest reported turnout were won by John Kerry by a margin of 11 to 7 in the aggregate. The 10 wards with the lowest reported turnout were won by John Kerry by a margin of 6 to 1 in the aggregate. Phillips cites the 10/13 break-in at Democratic Headquarters in Toledo, when computers with crucial data were stolen.
12/23 Mahoning County: Richard Hayes Phillips found evidence ES&S Ivotronic touchscreen machines were fraudulently set to default to Bush, possibly due to ES&S publishing the system password on its web site.
12/21 Warren, Clermont & Butler Counties: Richard Hayes Phillips found disturbing patterns in the three counties that produced Bush's entire margin of "victory" in Ohio. In Warren County, officials cited a bogus homeland security warning to keep the public and the media away from the vote counting.
12/20 Mercer County officials let a Triad technician "disassemble" a tabulator and replace a switch.
12/20 Lucas County officials let a Diebold technician reprogram the scanners in the middle of the recount.
12/20 Erie County officials let technicians replace a computer chip.
12/19 Prof. Ron Baiman updated Prof. Steve Freeman's analysis of the exit polls that predicted a Kerry win, and confirmed Freeman's conclusion that the results in the battleground states (OH, PA, and FL) and nationally were impossible.
12/18 Freepress.org revealed Ken Blackwell kept a secret slush fund - and also failed to keep a statewide inventory of voting machines for security. Freepress.org also found Shelby County discarded critical recount data.
12/18 Perry County: Local candidate Bill Crane discovered the number of voters exceeded the number of people who signed the books in at least 11 of 46 precincts, and 359 votes were cast by people whose signatures were never verified as required by law.
12/17 Mathematician Tim Lohrentz carefully calculated the number of disenfranchised voters in Franklin County (Columbus), concluding over 22,000 voters were likely kept from voting due to long lines. About 70% - over 15,000 - were in heavily Democratic precincts.
12/17 Cliff Arnebeck's Ohio fraud lawsuit - Moss v. Bush - was re-filed, two days after it was thrown out on a technicality.

11/29 Hamilton: Alicia Reese, Cincinnati's vice mayor, said 1,000 residents didn't have their ballots counted because they went to the "wrong table" at polling locations with multiple precincts and poll workers did not send them to the right table.

11/27 Hamilton: Kerry gained 1,778 votes from roughly 11,000 provisional ballots. But roughly 3,000 ballots were rejected: 1100 for voting at the wrong precinct, 400 for voting at the wrong table.
11/27 Sandusky: A computer disk containing votes was accidentally backed up into the voting machines twice by an election worker, causing it to look like there was an overcount.
11/25 Warren: Attorney Cliff Arnebeck challenged a 33% increase in votes cast, the second highest increase in the state (behind Delaware).
11/25: Federal Judge James Carr denied the Cobb/Bednarik lawsuit for an immediate recount.
11/24: Dr. Steven Freeman updated his Unexplained Exit Poll Discrepancy and calculated the odds against the exit polls errors in the 3 key states - Ohio, Florida, and Pennsylvania - at 662,000-to-1 - a statistical "impossibility." Exit pollster Warren Mitofsky told Keith Olbermann there was no significant problem with his poll. Pollster James Zogby told Olbermann 20% of Americans think Bush's "victory" was bogus and called for a blue-ribbon investigation.
11/24 Columbus: Richard Hayes Phillips says withholding of voting machines from predominantly Democratic wards in the
City of Columbus cost John Kerry upwards of 17,000
votes. Phillips blames Elections Director Matt Damschroder (the former Executive Director of the Franklin County Republican Party) and his co-conspirators.
11/23 Cleveland: Election officials rejected 8,099 provisional ballots - one out of three of the 24,472 provisional ballots cast. They rejected 5,595 because there was no record of their registration. "I find it inconceivable that over 5,000 voters in the county would wait an hour in the pouring rain to vote if they haven't registered," said Dr. Norm Robbins.
11/22: Cobb & Badnarik sued Ken Blackwell for an immediate recount. The Ohio Democratic Party joined the recount effort, and the Kerry Campaign will "participate."
11/22: After four public hearings, Bob Fitrakis described how the Ohio election was rigged for Bush by Franklin County BOE Director Matt Damschroder, who sent too few voting machines to black precincts in order to produce long lines and turn away voters. Keith Olbermann explored the Republican plan to delay the recount past the meeting of the Electoral College.
11/20: The Ohio Honest Elections Campaign, led by attorney Cliff Arnebeck, announced it would challenge Ohio's results, using sworn testimony collected at 4 public hearings.
11/19 Cleveland: Richard Hayes Phillips examined precinct results and concluded Kerry mysteriously lost at least 6,000 votes due to low turnout in the city (50%) compared to the surrounding county (72%).

They'll need $110,000, and are collecting contributions on their respective sites. Ralph Nader said Blackwell should resign in disgrace.

11/3 Lucas County (Toledo): Technical problems snarled the process throughout the day. Jammed or inoperable voting machines were reported throughout the city.
11/3 Mahoning County: using touchscreens, some races showed votes of negative 25 million
11/2 Hamilton County (Cincinnati): Problems with punch card voting machines delayed the start of voting for up to an hour Tuesday morning at a suburban precinct. Voters were unable to slide their punch-card ballots all the way into any of the six voting machines that had ALL evidently been damaged in transit.
10/31 Lake County: Voters received a memo on bogus Board of Elections letterhead informing voters who registered through Democratic and NACCP drives that they could not vote. Election officials referred the matter to the sheriff.
10/31 Cuyahoga County (Cleveland): Election officials received a spate of complaints after voters began receiving phone calls incorrectly informing them that their polling place had changed. In addition, unknown volunteers began showing up at voters' doors illegally offering to collect and deliver completed absentee ballots to the election office. Officials have not identified who is behind the tricks. "We've never seen anything like this before, where there seems to be a concerted effort to to give voters misinformation," Jane Platten said.
10/27 Lucas County (Toledo): The Toledo Police Department declared their investigation of the Watergate-style break-in at Democratic Headquarters "all but closed" - without finding the culprits.
10/16 Cuyahoga County: Three of the six South Dakota Republican operatives (Larry Russell, Nathan Mertz and Todd Schlekeway) who were fired for committing election fraud were hired by Ohio Republicans to work in Cuyahoga County.
10/13 Lucas County (Toledo): Thieves shattered a side window overnight at Lucas County Democratic headquarters in Toledo, stealing computers with sensitive campaign information and triggering concern of the local party's ability to deliver crucial votes on Nov. 2. Among the data on the stolen computer of the party's office manager were: e-mails discussing campaign strategy, candidates' schedules, financial information, and phone numbers of party members, candidates, donors, and volunteers.
Widely circulated "Voting Information" fliers from the "Bipartisan Voting Authority" claimed that "due to record numbers of registered voters this year," Republicans would be voting on Tuesday, November 2 while Democrats should vote Wednesday, November 3. The flier did not inform voters the polls would be closed on Wednesday.
Many of the issues above involve fraud. They form the basis for the contest filed on December 13. If the Ohio Supreme Court (controlled by Republicans, of course) finds enough fraud, it can declare Kerry the winner or order a revote - as in Ukraine.
If Kerry wins Ohio under either scenario, Congress would be presented with 2 slates of Electors on January 6 - one slate for Bush and one slate for Kerry. If one Senator and one Representative file a written motion challenging the Bush Electors, the two Houses of Congress would have to begin an immediate debate.
In 2000, 14 Representatives led by the Congressional Black Caucus filed written motions challenging Florida's Bush Electors, a scene made famous at the beginning of Fahrenheit 9-11. But no Senators were willing to join them, so there was no debate.

So far all the evidence of fraud has been anecdotal but there is one group that is getting the hard evidence--and it's there--Blackboxvoting.org. Blackbox voting needs to raise $50,000 to file freedom of info act requests for as quickly as possible to pay for records and the fees some states charge for them. Black Box Voting (.ORG) is conducting the largest Freedom of Information action in history. At 8:30 p.m. Election Night, Black Box Voting blanketed the U.S. with the first in a series of public records requests, to obtain internal computer logs and other documents from 3,000 individual counties and townships. Networks called the election before anyone bothered to perform even the most rudimentary audit.

The Democrats are continuing to commit the mistakes that got them where they are.
I'll give you a great example: Bob Wexler. Now, you may not remember the name. He's a Congressman from Boca, and the people down here in Florida were just so discombobulated by what they made up.
They made up a story that the election was stolen from them. They made up a story. They lost that election. CNN, New York Times, ABC, all kinds of news organizations, came down, counted the votes five different ways.
Bush won all of them. There was no way Gore was going to win the presidency or Florida in any way, shape, manner or form. But they would not give up the fact that it was stolen from them, and so for the next four years, 2000 to 2004, they fought the 2000 election in 2004 in terms of trying to make sure there wasn't any more fraud, when there wasn't in the first place, and Wexler is out there suing this and that, demanding a paper trail out of voting machines. He lost it in federal court.
In the meantime, what they weren't doing was actually planning on winning the 2004 election. They were so afraid that they were going to have it stolen from them again. The same thing is happening to them now in Ohio. They simply are so governed by the past that they can't look forward, BUSH WON GET OVER IT...........

Kerry Must File Suit To Start Ohio Recount Immediately!
The lawsuit that Kerry joined is about getting rid of a temporary restraining order by a county that does not want to participate in the recount. The lawsuit I'm talking about here is trying to impose a temporary restraining in order to start the recount immediately(the Greens tried this and failed because they could not be "harmed" with an incomplete recount since the Greens would not gain any electoral votes, as Kerry could). Its two different things and they're both very important! The current timeline is impossible (Blackwell is set to start the recount on the 11th while the safe harbor day when Ohio is supposed to choose its electors is on the 7th and the day that all the electors choose the President is the 13th, while a full hand count will take at least 10 days!), this is why the Greens wanted to have a lawsuit to expedite it! The other lawsuit happened because a county sued to opt out.

Narrative IS Necessary
We've been seeing some great efforts to audit the (s)election results. Yours is certainly top tier.
But I think something necessary is missing that could help engage other in the effort and even inform our actions. Particularly your FOIA requests.
I think all, who like you and I, refuse to let this second act of treason pass need to understand and project the narrative form what actions were taken to steal the election this time. How differed from the last time: to try to avoid both the detection and the successful legal challenge that they had to overcome last time.
The narrative is this:

Their plan was to reduce the number of Dems who were able to vote: long lines, faulty machines, late absentee ballot delivery, dumping college registrations, etc.. But in ways that defy quantification.
What they added this time was also a false "turnout" on their own side. This involved pumping an extra 10-15K "votes" in counties where they could get away with it. Part of the scam was to file large numbers of false registrations. Recall they spent weeks calling this a "crime" by Dems. Why would they think is such a bad crime? It's not as if Dick Tracy was going to show up to vote. They considered this a crime because they were doing it with criminal intent. So their false turnout would not be detected.<<
Why this is MOST important is that we MUST also demand that registration lists be released. And that they be audited by contacting real people, and not just assuming that Rep claims of "culture voters" or "gay marriage voters" or "the success of our Reg/GOTV" are factually accurate. This method of registering and voting non-persons is something they are very experienced at, particularly in FL. Just look at the results from Escambia, Duval, Clay, Collier, and other Rep dominated counties. Their "results" defy common sense and must be audited/confirmed.
But please, help disseminate the "narrative" of this conspiracy. It makes it much easier for people to map the individual incidents and hold fast to their belief in a second treasonous election theft.
It will be invaluable if (as is most likely) we need to make our stand on a political/p.r. basis come Jan. 6th 2005. That is the day that ANY and ALL crimes against our democracy can be rendered null by simply getting the public and congress to apply a just result by disallowing tainted electors.

They were trying to spin it like crazy all Election Eve and ever since...provisionals are not usually bad votes in Ohio. Check out the numbers in the quote below and the link to the Dispatch...that's Blackwell's spokesperson quoted. More than 90% of provisionals were counted in Ohio in 2000 and 20002. I looked this up early Wed when returning from manning Copley network news risers from 1 p.m. till 3 a.m. I called CNN shrieking to get the numbers right and not state they would, of course, mainly be "bad votes" so why count them. Finally Hemmer stated it on air. One minute later an Ohio spokesperson for the repubs came on spinning away about how provisionals hadn't been good in the past in...Illinois!!!!! And CNN didn't say hey, aren't we in Ohio where they usually are good? Check it out...

We Must Urge Kerry To Do Recount!
What people have got to start understanding is that Kerry's concession is political (and psychological) not legal. Kerry still has until 5 days after counting the provisional ballots (which will not start until 11 days after the election) to decide to do a recount!
I'm hoping that with mounting evidence of fraud and calls/faxes and petition (I'm working on this) Kerry will ask for a recount. If not a citizen group in Ohio and perhaps the election protection people will contest and hopefully get a recount. But if Kerry just asks he gets it--he doesn't have to prove anything and he has the money for a recount. This is the best way so I think the number one thing is to encourage him to do so. Greg Palast has looked at the data and concluded that once legal provisional ballots (which will be counted no matter what )and legal spoiled ballots (in a recount) are added up, Kerry wins Ohio and the election.

I received numerous copies of the e-mail below, so I called Cynthia Butler to get more information.
Cynthia confirmed that she is the author of this message, and she did work for the DCCC in Texas this fall, where she did witness voting problems.
She also confirmed that she spoke with Cameron Kerry and told him about these problems. He did not, however, indicate that John Kerry would "unconcede."
Therefore the headline is misleading: Kerry has not stated he would "unconcede."
Cynthia is trying to collect as much evidence of voting interference as she can. Much of that data has already been collected for Ohio (2580 incidents), Florida, (3592 incidents), and all of the other states.
In order to persuade Kerry to pursue a recount, Democratic activists need to document enough errors and fraud to eliminate Bush's election night lead of 136,000.
I am tracking all significant (1000+) items at the top of this blog.
Recount legalities
I spoke with some Ohio election lawyers and this is my understanding of the recount process. (Note: I am not a lawyer.)
The official count is conducted 11-15 days post-election, so that's 11/13-17.
That count will include 3 categories of ballots:
a) Ohio: registered voters who moved without updating their registration, who are allowed to vote (and can update their address while voting)
b) HAVA: registration "glitch," such as not appearing on voter list, or first time voter without proof of residence
When that is completed, Secretary of State Kenneth Blackwell will certify the result.
There are then 2 kinds of recounts: free or paid.
A recount includes full access to documentation, including poll books, programs, and ballots. It might be possible to get independent testing of software, but that is a new issue.
A recount must be requested within 5 days of certification, so that's 11/18-23. The recount must be conducted within 10 days of the request, so that's 11/19-12/3.
After the recount, a contest can be filed by either the losing candidate or 25 electors. A contest is filed in OH Supreme Court, where it is decided by the Chief Justice alone. (The Chief Justice is a Republican.)
In a contest, the candidate must demonstrate election irregularities that could have affected enough votes to change the outcome. The burden of proof is "clear and convincing" evidence.
The problem for a contest is that it runs up against the Electoral College calendar: any disputes over choosing Electors must be resolved by 12/7; the Electoral College meets on 12/13.

Can someone explain that just because they didn't use the newer Diebold machines (according to the Ohio Democratic Party site), all is well? It seems to me that several years ago when the Orwellian HAVA was passed, ChoicePoint, who had the Bin Ladens as investors, wanted into the voting machine business. In fact, it was CP that helped scrub the FLA voter roles. And I get to my point: Bev Harris has it right - anywhere there were machines, there was probably bushwah going on. Can someone tell Oh-high-oh that?

Call to Action: Let Democracy Ring the Capitol on December 11th!
This is a Call to Action. It is time to remind this nation and the world that this Government was formed by the People, not politicians, judges, or media pundits. We've broken free of a King George before, and by God, we need to wake up and do something NOW before we lose our democracy. Here's what we will do:
1. On Saturday, December 11th, before the Electoral College convenes in each of the States on Monday, the 13th, we the People will peacefully assemble in a huge symbolic ring around the Capitol in Washington, D.C.
2. We will call upon the Electors to convene, then recess and temporarily postpone their presidential vote.
3. We will call on the four living ex-Presidents (Ford, Carter, Bush-41 and Clinton--two Democrats and two Republicans), to convene and review the grave evidence of election fraud and disenfranchisement.
4. By noon Friday, December 17, if all four former Presidents can certify to the People of the United States that these elections were fair and free, and the outcome is not in dispute, we will stand down. The Electors can cast their ballots in time to meet the December 22 deadline for submission of their votes to the Senate.
5. If the former Presidents cannot so certify, we will call for new elections to be held nationwide for the Presidential race, within one month. (The inauguration party may need to be postponed a few days.) Candidates will be permitted to campaign only in the final week before the new elections.
6. The new elections will use paper ballots that will be hand-counted. No machines or computers will be allowed.
7. The process will be transparent. Representatives of each candidate will be permitted to observe vote counting, and it will be recorded and made immediately available to the public.
Begin the organization now. Send this message to everyone you know. If hundreds of thousands, or even millions of Americans show up on December 11th peacefully surrounding the Capitol, that singular act might change the course of history. We owe it to all those who have died for our freedoms to stand together now. Let Democracy Ring the Capitol!

There needs to be a demand for poll books
In both Franklin and Mahoning counties in particular. Since there is no paper trail, we will need to go over each and every person who voted, come up with totals, and check against the final tallies. It is guaranteed the numbers won't add up, then we can push for a revote through mass protest. That is the plan as I see it.

The problem comes in when you face electronic voting machines that don't give you any paper and wich can be ruled by secret forces (like in the casinos), the best way to make sure of the result would be to use papers or any other hand made ballot.

Dear Senator,
As you are probably aware, allegations as well as evidence of election fraud in Ohio are mounting with each passing day. Each day that passes brings us one step closer to inauguration day. We must, as party, use our political clout and mandate to prevent a repeat of the 2000 Florida debacle. There is a chance that John Kerry is our president. Until this chance has been proven or discredited, democrats must continue fighting.
There are movements (http://democrats.com) underway right now to lobby Senators to challenge Ohio's electors on Jan. 6 2005. All we need is just one Senator with the courage to stand up and fight for the truth.
Senator, the fight is not over yet. We cannot give up in this moment of truth. We cannot shrink from our responsibility as protectors of truth and justice for the sake of 'moving on as a nation'. The integrity of truth and justice as well as the sanctity of our election process and right to vote overrule the need to 'move on'. We must fight to maintain the integrity of these institutions as pillars of our democracy or we run the risk of making a mockery of our 'Democratic-Republic' and the values which we feel, ironically enough, are worthy of imposing on other sovereign nations.
We must not allow apathy to infiltrate this party. Assurances of future investigations, legislation and election reform will accomplish with respect to what is happening now, ‘on the ground’ in Ohio. If we allow that man to be inaugurated, nearly half of the citizens in this nation will have no representation in the federal government for the next two years. Think about that. I mean really think about it. Do congressional democrats really have the power to withstand the republican majority? With a republican majority in all branches of government the checks and balances system will be all but obliterated. Is that what you want, despite the fact that we are in a perfect position to do something about it now?
We all fought very hard to make John Kerry our president and we were all equally devastated, to the point of depression, after John Kerry conceded on Nov. 3rd. After that day, many of us lost hope. But a tiny flame is still alive in Ohio. Let’s kindle that tiny flame into a national firestorm. Let us dispel this notion that republican ideals represent a majority of American opinions. Remember, there are 57,313,461 people out there just waiting for the opportunity to continue this fight until the bitter end. Please join your countrymen and fight. Please, Senator, support this effort or help us find another Senator who will.

Procedures for Selection by House on January 6th
Bob I have a question, was wondering if you might be able to answer it for me. The Constitution provides that, in the absence of a majority of electors for either candidate, "then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote...." How is it determined what each state's vote shall be?

Is there any way we can get this action out across the nation to all democratic committees? I know it's not binding, but it might put some pressure on our Senators?

At what piont in time, will the DNC make a definitive & final statement on the Ohio 2004 Final Vote Count? A 'deafening' silence is occurring, this is not Senator Kerry's decision but a matter which goes to the very core of our governmental process. When is the lead for this inquiry going to be taken full inhand by the DNC, this with due respect for Rep. Conyers' and other leaders' good efforts on this matter?
Leadership and responsibility have to be excerized on a regular basis to retain it's shape and function. "Sunshine Patriots" do not win the field or are they reliable enough to be entrusted with sentry duty.
DNC don't jeopardize your apparent'preferred' work assignment as collector of the monies!

This is a direct quote from Andy Stephenson, aka god_bush_n_cheney, as of today:
'To the people of NJ from Andy Stephenson. I just spoke with Frank Lautenberg in the elevator. I first asked Senator Lautenberg if he had a few minutes to talk to me. He said yes. I began to talk to him about the voting issues I found in FL and OH. He couldn't get out of the elevator quick enough. Being the tenacious person I am, I followed him out and asked, "Senator won't you please look at the evidence? Won't you please stand with Mr. Conyers? Won't you please stand for the American People?" Mr. Lautenberg said, "I don't want to hear this." I said, "Mr. Lautenberg, I have seen the evidence, I've seen it with my own eyes. I discovered it." To which he replied, "If you don't leave me alone and stop harassing me, I will have you arrested." I said to Mr. Lautenberg, "If you stand with Mr. Conyers, you will be a hero."
