Dismantling the Constitution
One of the oaths every President and Vice President take when they assume office is to "preserve and protect the Constitution of the United States". How has Bush done in that respect (and I use the word respect loosely)?
Let's take look at some of the articles and amendments.
- Amendment I - Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
- I don't believe there has ever been an administration that is so ready to tear down the philosophical barrier between church and state. From respecting the church doctrine on abortion and homosexuality to teaching creationism (let's be realistic, Intelligent Design is just a new term coined for creationism) in schools at the exclusion of evolutionary science.
- Freedom of speech? Let's see, if you dared to speak out against Bush (especially in the months following 9/11) you were branded as unpatriotic at best and a seditionist and traitor at worst.
- Freedom of the Press? The administration will not allow the coverage of the return of dead soldiers from Iraq. They attempted to talk several news organizations out of releasing some stories (i.e.: NY Times and the wiretap story) while pushing propaganda or their own agenda onto FOX or other news outlets (Robert Novak and the Valerie Plame story).
- Amendment IV - The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
- The Patriot Act anyone?
- Bush authorizing the use of illegal wiretaps easily violates the fourth amendment of the Constitution.
- This is also in violation of the Foreign Intelligence Surveillance Act (FISA).
- Amendment VI - In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.
- There are some American citizens who are being held without trial or defense.
I believe it is important that we recognize that Bush cannot, even with the approval of Congress, be above the Constitution. While the Constitution does not give us the rights mentioned, it does in fact guarantee those rights. These rights and liberties were there before the Constitution was even written. The Constitution was framed to secure our liberties, not just against foreign intrusion, but especially against oppression by our own government. The framers of the Constitution set specific limits upon the President (and the other two branches of federal government) and reserved to the people (yes, that's you and me, and even Republicans and Democrats) all powers that they did not grant. The Ninth Amendment clearly states: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."
George Bush is not a monarch, he is not a dictator - even though he wishes he were ("If this were a dictatorship, it'd be a heck of a lot easier, just so long as I'm the dictator." —Washington, D.C., Dec. 19, 2000) - he is a man who, "solemnly" swore that he would "faithfully execute the Office of President of the United States, and will to the best of (his) Ability, preserve, protect and defend the Constitution of the United States." In that respect he has failed horribly to the detriment of that great document and the nation and people it represents. For this he should be ashamed, but he is shameful of nothing he or his representatives do or have done.
These may well be the saddest and darkest days of our nation since the American Civil War.

Right now I'm listening to some talking heads saying Bush's poll numbers are going up, that he will regain the momentum, and laughing at the "do nothing" Democrats.
2006 is going to be so critical. Dems need to come out swinging.

John Rothman, on his KGO show early this morning took the stance that the 'leaker' should come forward and admit that he was the leaker.
Purpose would be to get this case into court to determine exactly where Bush's(presidential)powers start and end. Rothman claimed that this would shine the light of democracy into some very dark places.
The leaker would have to be armed with a very good group of attorneys. The issue is important enough that DNC funding should be found to protect the leaker(whistleblower). It might also defeat the major media in their efforts to keep the matter hidden.
Same thing happened with CIA
Same thing happened with CIA leak too. Don't blame the people in the White House who LEAKED the name but lets divert attention to the news reporters.

How dare they?
How can we stand still while there is a search and destroy mission to kill the messenger when it/she/he/they revealed a crime while the criminals are not only allowed to go free but also start the investigation and will see it through? What kind of police state do we live in now? I think that I should stay at home and watch Fahrenheit 451 to help ease me into the new American order. All doom and gloom aside, the Democrats in Congress better be stocking up on their Wheaties and energy pills to come back fighting or truth, justice and the American way will soon be replaced by the ideals of Jack Abramoff. Take money wherever you can get it. Pillage and plunder all. Remember it's okay if you make people think that the only real enemies are from the Middle East and that our president is doing everything possible even stealing our rights to protect us. Who will protect us from him? May 2006 be the year when Bush has to explain to us why he is systematically destroying the United States of America and be held responsible for his crimes against us and the rest of the world.

You see we have an Attorney General who counseled this President as to how to circumvent and violate The Constituion..
The AG as well as other Attorney's who should be disbarred for this why isn't The ABA doing any investigation or holding hearings..for disbarrment..?
Also there is a section of law many do not know of well more than one..
First there is the 1989 Statue that makes it a Federal Crime to Conspire to violate the Civil Rights of a person or group..
How has Gonzales not conspired to violate the Civil Rights of thousands, more as we now know with this NSA abomination..?
Also there is a little known section of Tory Law called "Ex Rel" that's Ex Relationi, or in relationship with the king or state, it allows you to file the "properly drawn instrument of the court" and criminal charges when the proper authorites refuse to do so or in this case are incolusion with the perpatrators..
"perpa-traitors" I say..and You can prosecute against the criminals..
Gonzales has such a serious conflict of interest in this regard and as we all know has waited 1 year to cover his crooked boney ass..there is a crisis of much larger preportions than many realize, The Federalist Society has infiltrated the Dept. of Justice to such a degree when a Federal Attorney speaks we don't know really who they represent the Fed. Soc. or The People of The United States..and Justice Department..this conflcit of interest is really serious it's a true Cabal of anal attorneys very dangerous to the Republic and a true cabal a group within a group..
So a Citizens Arrest is in order using Ex-relationi of the Attorney General..Gonzales and also Michael Chertoff most likely as well as Meirs and
Bartlett et al all who were attorney's who counseled the President to break the law any law..
Try them in absentia if need be, but I hope the Democrats see fit to file charges and any and all radical or moral attorney's and paralegals should research Ex-Relationi and use it for the multiple grounds Gonzales has violated and counseled his client to break the law absolute grounds for disbarrment..QED..
