A Small Aside From Florida

Apparently one of the things that was voted on in Florida during the 2004 election was something put together by the American Medical Association (this is what I heard from a friend).  Apparently, the AMA sponsored a bill that would limit what attorney's could make on malpractice cases to 150,000.  I would imagine that this has, in effect, stopped most malpractice suits in the state since the attorney's now don't want to take the cases to court since they, in some cases, won't make any money on them or would in fact lose money on them.   If anyone can shed any light on this it would be appreciated since I have a friend who has a very legitimate suit that was just told by her attorney to forget it.

$150,000 Small Amount?

The main reason that lawyers dont want to take any case under that amount is b/c they are among the greediest profession in America. Lawyers in MI charge 200-500 an hour, 300 being the average. How ridiculous is that. They are out for the large sums of money to get rich quick.

That is why the limits not only on medical suits, but ALL suits, is a great thing. The lawyers will learn to accept less pay for their mediocre service, and liability costs will stop skyrocketing in all areas.

To charge a reasonable hourly

To charge a reasonable hourly fee, lawyers would need to:

1) Operate from sensibly-priced offices;
2) Do most of their own work;
3) Actually TRY to settle cases quickly, and fairly; and,
4) Live within their means.

It ain't gonna happen...

The most litigious group of people in the nation has statistically been proven time and time again to be:

1). Corporations and business
2), Republicans

Mayabe instead of limiting the amount one could receive we should just limit the number you could file over a lifetime. That would shut the Repugs up real quick.

Amen just the same

I totally agree about all of corporate america, but not the rep. comment. Both sides are extremely litigious, and the lawyers (who are extremely democratic) take advantage. I believe that all suits should be severely limited. The whole lawsuit system is out of control.

An Aside from Florida

The only problem is that it's the victims of malpractice who will suffer the most not the attorney's who refuse to take their cases to court.

You got a source for the Republicans part of your post? Meaning, to which statistics do you refer? And actually, since you say "time and time again", could you provide there should be multiple sources you refer to.

BOYCOTTS

Hey There,

I really feel that the country is now firmly controlled by corporations. They have created a class and ethics war amongst the parties to keep us from talking about the economic hardships we are all facing.

Boycotts would affect the bottom line of these corporations. How is everyone else feeling about boycotts? Do you think it is do-able or would only the folks on this board participate? I am thinking of course that a website and media exposure is a must for any real impact.

I boycott Disney. I don't buy gas at Exxon. I DONOT EVER NEVER WILL EVER UNDER ANY CIRCUMSTANCE EVER PAY FOR ANY KIND OF PRODUCT MICROSOFT PRODUCES OR EVER WILL PRODUCE. I'm not particularly fond of AOL so I don't buy that shit either.

Boycotts

I believe there are some people on dailykos.com who are looking to establish a web site to do exactly that...you might want to check it out. They are looking for people to help, etc.

Boycotts sometimes effective

Remember in the not-so-distant past that Sinclair softened its position on showing the anti-Kerry stuff after people boycotted their programming (I believe their ratings went down) but the main thing was that some advertisers withdrew their ads and investors threatened to sell their stock. There's more than one way to boycott!

Malpractice limitations

A similar law was passed in Texas in which limits lawsuits for pain and suffering to $250,000 per Physician up to $750,000. However, one problem that is consistently ignored is the fact that the AMA will protect doctors no matter what. There is a doctor in San Antonio in which, according to my attorney, has been sued 42 or 43 times. I also know of a woman on my route (mail route) who's daughter was essentially murdered by a hospital. Had her lawsuit not been filed by Sept. 1, 2003, the loss of her child would be worth $500,000. How many people do you know would be willing to trade their only child's life for half a million dollars? Less, attorney fees and legal costs of course.

Malpractice Limitations

I couldn't agree with you more. I personally agree that attorney's get paid too much money, however, I also think that if the AMA did a better job of policing its own then there would be no need for "frivolous" lawsuits or any other kinds of lawsuits.
