This the second in a series of action alerts about the fundamental willful and pernicious errors underlying the decision by 5 agenda driven right wing judges on the Supreme Court to gut all restraints on corporate meddling in our elections. Each of these successive alerts will analyze additional derelict aspects of this shameful and truly dangerous decision, to further demonstrate why we the people must speak out and act to reverse it.

In the first alert we made the triable case (which no attorney has written us to dispute) that failing to even bother to distinguish between domestic and foreign owned corporations, and knowingly leaving America vulnerable to the latter BY their ruling, was de facto an act of treason by The Supreme Court 5.

This alert will focus on their abandonment of every prudent rule of judicial review, in favor of haste and the most extreme form of judicial activism, again with specific page number references to the opinion itself.

The most bedrock principle of appellate review is that first an appellant must have PRESERVED the issue for appeal, by arguing and getting a ruling on the point of law from the court below, necessitating fact finding by the lower court to create a "record". Innumerable appellants since the beginning of time have had the door to review slammed in their face with the admonition that if they HAD preserved the issue then and only then could a higher court review it.

And in particular, appellate courts have traditionally been loathe to making their own findings of fact (and only in a corrective way) absent very clear error by the Court below, which is as it should be. The role of a higher court is to apply the law to the facts, and make rulings of what the LAW is, not make their own findings of fact. And this is supremely true of the Supreme Court.

So even beyond the outrageousness of the result, it is at least outrageous the way it was reached, and how that reach was justified. As justification, The Supreme Court 5 asserted that some legal emergency existed requiring a broader inquiry in this case, resurrecting a claim already ABANDONED by the appellant in the court below (opinion p. 12). Why directly overturning precedents at least 20 years old would suddenly be such an emergency they do not explain.

And when you actually read the opinion, the only pressure really on the Supreme Court was because so-called Citizens United was bound to LOSE on the case they did preserve (opinion pp. 10-11). The Supreme Court 5 wanted that party to win. This was in itself an over the top act of judicial activism. But even beyond that they were hell bent on undoing as much as 100 years of campaign finance regulation (Stevens' dissent p. 3). Even the most conservative commentators agree this is what they have in fact done.

Appellate courts have been known on occasion to comment (in no binding way) that if an appellant HAD made a particular argument they might have been receptive to it, a kind of higher court invitation for someone to bring an actual case, an actual "controversy". And then there would be a factual record in some subsequent case. But here there was no controversy on the issue on which the ruling was based, for it had already been WAIVED a priori, thereby denying the Supreme Court any jurisdiction to rule on it (Constitution Article III, Section 2, Clause 1).

But even further assuming that the Supreme Court was justified in reopening a can of worms already discarded, the appropriate procedure would have been to return the case to the lower court with instructions, what is called a "remand", and which is done all the time after a ruling of LAW, for the court below to make findings of fact and conduct further proceedings, so that there would be a factual record for them to review, should the appellant wish to appeal to the higher court again in the case of an unfavorable ruling by the lower court.

All these prudent judicial things are exactly what the Supreme Court 5 did NOT do. Instead, they called for hurry up further briefing on the new question of law THEY wanted to rule on (Stevens' dissent p. 4), in a vacuum of insufficient facts to make those arguments of law. Instead, they set a scary new purported standard of review that says they basically can make rulings on any point of law THEY want to raise, whether developed in a lower court by an appellant or not.

This is truly frightening! It means that these five absolute dictators in black robes have now asserted the unheard of prerogative to make their own law pretty much any time they like, if only tangentially related to appellant's actual arguments on appeal (opinion pp. 13-14), a profoundly dangerous NEW standard, to become a new stare decisis if not immediately challenged and reversed by their removal from office. It means they now assert unchecked prerogative to make their own findings of fact whenever necessary to reach the result THEY want to reach.

And they must be stopped. The Supreme Court 5 must be impeached before they go even further off the deep end. Whatever else within the law that Congress can do to counteract this decision must be done, and to make sure such a thing can never, ever happen again.

The 5 Supreme Court Justices by treasonous judicial activism ruled, that having defacto allowed national and multinational corporations to subdue the peoples vote thus direct the American Democracy.

Political euphemisms, today are used effectively to lull the US citizens and our government to sleep with the ultimate goal to suppress all actions on both parties parts. it is my goal to wake-up the American public to the euphemisms used to blind us by using the correct words to describe direct threats, and forces we are currently facing today, but until now, have been incorrectly viewed and tolerated by us. By unmasking the Terrorist and exposing the Politically Incorrect euphemisms being use to hide them the real "Terrorist Attacks" whom All of us are currently suffering from in America today. By identifying and exposing the Terrorist cor who are hiding among us. We can finely start to "Combat Terrorism and the Terrorist Attacks being waged against us."

As the late comedian genus, George Carlin so expertly exposed during many of his comedy routines, about the use of defused euphemisms to distort true meaning and reality. He used as a perfect example, War Veterans, and the words used to describe the euphemisms terms used against them, to wake us up, and see the true meaning. The words used after wars used to describe Veterans returning home from battle and how the euphemisms over time changed from war to war. Starting with and working back in time. The Vietnam war, veterans returning home from the war suffering Physiological trauma, where ignored and never treated because of use of weak euphemisms used to describe there condition.
Used against all war trauma victims at the time, the new defused euphemistically, designed definition title was; "Delayed Stress". The term was used to defuse the impact of the real word, reducing the true impact veterans were truly suffering. Thus refusing them the care they needed. The previous terms used, you get closer to the real true meaning and suffering to describe veteran returning from war during WWII, the term was "BATTLE FATIGUE" abit harsher, but understandably real, but to get to a real understand and true definition of what all vets are suffering your must go back to the original word used during and after WWI which accurately describes correctly what the vets where suffering from which was "SHELL SHOCK!"

We all Know that Fear is the Terrorist weapon used to control people and our government through fear.

This insidious privacy invading tools is now being used by many Insurance industry, NSA, CIA,FBI, Banks, Credit card and credit reporting agency,
and more companies are using it every day to find ways to parasitically attach your wealth or assign a price tag on you for their benefit only.

NURV is a modern day discrimination tools or weapon use by corporations.

If NURV is used against our Medical records we will be dammed. Let don't let them compile medical info on us.

DNA and Gene Profiling is already being done on our new born babies at hospitals with out our consent and retained forever by? it must stop now. these tools are not for our good being used only for corporate profits now and in the future.

One good thing about some Banks, at least, when you give them your money you can get it back if you need to use it! this is not true for Insurance HIBI Terrorist Group! Like State Farm Insurance current pull out of Florida due to the possibility of Hurricanes. its a sham that all those people paid all year do not get a full refund from Farmers Insurance after they never preformed. Its the same as paying for something then never receiving the product. You should get a full refund, We should make this Law for insurance companies who pull-out and renege on a sale and fine them above total cost and also have them pay all the customers back in-full. Additionally if you never get to use the product then you get a refund after the paid period. its only fair because thy used your money interest free for that time.

Insurance companies are Parasitic Money Handlers sucking money from all of us.
All insurance care about, is taking your money. Their Go-between middlemen, and so called "examiners" who they employ, know they are traitors and nothing more than; Death Panel-Plug-Pulling-financial hit-men, for the HIBID insurance industry Terrorist Group. these examiners are used to maximize profits off the sick and dieing or as soon as you need help.

Hunting and hounding us at every turn, we have no escape we are running as fast as we can to avoid capture, but time is running out, the Fascist Capital Credit Corporations are upon us now!

In this "War on Terror" Presidents during War must use all the weapons at their disposal, such as: Signing Statements, Proclamations, and declarations, SRT, FBI, S.W.A.T., CIA, NSA, direct Military Attacks, and Bombs to combat, the HIBID Terrorist Groups and their Terrorist Lobbyist, "Enemy Combatants" on U.S. soil, of witch a large Terrorist stronghold Base in Washington D.C. on K-Street is currently located. along with other nefarious Front Groups everywhere as has been reported by Wendel Potters ex head of CIGNA corporate Communications and recent defector and now freedom fighter with inside intelligence on the Terrorist Insurance Propaganda and Terrorist Network Tactics. We know they have large network data base files NUVR on almost all of us in their data bases mining farms, ready to be used selectively against us for their strategic financial benefit.
 
Use the FCC to stop/block corporate advertising agencies Propaganda Commercials of Drugs Co., fake Insurance, and bogus Credit Card and Mortgage Banking Rates, simply out-law them, as we did with: Alcohol, Fire Arms, and Tobacco Smoking. Other countries around the world have policy forbidding such propaganda that have protected their citizens from becoming victims of negative rhetoric and commercialism. Additionally Ban or dismantle the FDA who are in collaboration with Drug Companies and insurance cartel. The FDA should be indited for mass murder of hundreds of thousands of people worldwide.

The only Nuclear Weapon Option of choice, that the HIBID Terrorist Fear is: (H.R. 676) Single Payer Option, by using this weapon you will be saving and freeing Millions of American Hostages from the Brutal HIBID Terrorist Attacks and Ransom.

Medicare for All, (HR 676) Single Payer , its the only way to free the U.S. Hostages from the HIBID Terrorist and their deadly Ransom Demands.

This is the only weapon we can use to stop the HIBID Financial Terrorist. Insurance insiders understand and agree that it will releases the Hostages and stops the Ransom money. The Health Insurance Banking Industry Drug inc. HIBID understands the money saved by (H.R. 676) Not-for-Profit system would no longer go to support them. 33 Trillion Dollars worth of income Ransom money would be saved, thus not go to them - Yes - this savings amount would increase as time begins showing lower true costs, for actual real care services, instead of going as Ransom to supporting HIBID Terrorist Groups leaders. But this savings can only be realized by our government, Patents, Doctors, and Hospitals... once the HIBID Terrorist are expelled and defeated.

The Insurance Industry is totally aware how (H.R. 676) will effect their ransom bottom line, and will fight tooth and nail against any benefits gained by our Healthcare System.
The savings of Trillions in ransom cost over next 5-10 years, will go to our Healthcare System,and infrastructure instead of HIBID.

This is why we must destroy their powerful weapon of money, and stop the infiltration of our legal system and government from being used to create laws

(but this is their mail goal) the People are not Stupid when, a US Senator defects, turns traitor joins the HIBI Terrorist Group for Money, is he not a Traitor? to his Nation, People, Government, and the U.S. Constitution!
