CA, Berkeley: Berkeley Prepares to Protest John Yoo's Retention at UC

In a post to the Contra Costa Times over the weekend, UC Berkeley's School of Law Dean, Christopher Edley confirmed his determination to shield "Torture Professor" John Yoo from accountability for well documented crimes against humanity. Edley's misapplication of an "academic freedom" defense not only enables UC to continue harboring a known war criminal against community wishes, but calls into question the Dean's motivation for protecting John Yoo.

Faculty, student and alumni calls for disciplinary actions are not based on what Yoo said, they are based on what he did. UC Berkeley's code of conduct provides for dismissal pursuant to criminal conviction. Yet according to law professor Christopher Kutz, "disbarment proceedings and 'serious professional ethical violations,' such as knowingly giving bad advice, could also lead to Yoo's firing." Boalt has a duty to assess John Yoo's actions no matter how uncomfortable those findings may be.

This Friday, April 10, FIRE JOHN YOO and WORLD CAN'T WAIT will confront UC recalcitrance to do the right thing.

John Yoo

Yes, John Yoo should be disbarred as he has clearly demonstrated that he neither understands nor believes that the US must follow the US Constitution, US Law, International Law, nor International Treaties to which the US is a signatory.  Which is why we have held more than one protest in Orange, CA in front of the Chapman University Law School since that is where John Yoo is currently a visiting law professor.  If John Yoo is in Orange, CA, then why hold the protest in Berkeley... unless it might be easier for the Berkeley Administration to remove John Yoo for his unprofessional behavior in regards to being an open & frequent proponent for torture... despite its illegality for decades.

Excuse me, but has Yoo been found guilty...

of anything by a duly constituted court? Otherwise, he is being found guilty by a kangaroo court. Have his 'crimes' been proven, has he been indicted, has he been tried, has he been found guilty by a jury of his peers? What happened to 'due process' and 'deemed innocent' until proven guilty beyond a reasonable doubt? Sounds like a Judge Roy Bean exercise in Bush-like behavior.

Grinch, many people are "fired" without having been found guilty of any punishable crime. Quoted from the original post:

I really don't care whether or not Yoo is fired from his post at Berkeley (after all his buddy Bybee still sits on the Federal bench) but I definitely would like to see him prosecuted for attempting an end-run around established US and International laws against torture.

assessment of Yoo. Question is how we go about getting this guy into a court of law? The same applies to KindaSleezy, Bush, Cheney and the rest--a cast of thousands.

Why are there no special investigators being appointed? Endless reviews, as our congressional leaders want to go, is hardly the answer. Their track record of finally getting these people into court is hardly encouraging to any of us.

In the meantime, time passes and these criminals(I am pre-judging here)continue to breath free air.

There is one person who can make a special prosecutor happen. Will he?

I totally agree Grinch, and

I totally agree Grinch, and the time for "studies and reviews" is long past.

As the clock continues to tick, and the opportunity to act grows more distant, my only assumption is that those who hold the keys to the castle are afraid that their own levels of involvement and pre-knowledge may come to light.

Impeachment of Bybee, and the disbarment of Yoo, will do nothing to address the fundamental damage done to our Constitution, nor to our national psyche.

If we don't handle all these people...

with 'legal precision,' they will all end up walking away.
